UPDATE: Emergency Rules Contemplated

  1. specific counties and/or zip codes that still have more than 50% of premises without power; and
  2. customers that can document that they have been affected by the hurricane through any of a variety of means (receipt of assistance)
For Centerpoint customers the zip codes affected are identified as the zip codes shown in red or pink on the following outage map as well as zip code 77661 (on Galveston Island) are automatically eligible:
 
 
For TNMP customers they may qualify under option 2, above.
 
For Entergy customers in the following counties are automatically eligible:  Orange, Chambers, Jefferson, and Galveston counties
 
Customers of all TDSPs who are not automatically covered under item 1, above, may be eligible for protection under the emergency rules by providing documentation that they have been affected to the REP.
 
Finally, the emergency rules would only be effective until October 10, 2008.  The Commission may revisit these rules at their Open Meeting on October 8th.
 
The order will also direct ERCOT to utilize any revised premise counts (premises no longer receiving electricity) expeditiously in performing wholesale settlements.

In response to hurricane Ike, the Commission is considering an emergency rule at today’s Open Meeting. If adopted as proposed, the rules would prohibit REPs from refusing electric service based on the customer’s inability to pay; and would prohibit REPs from requesting DNP’s. The rules would be in effect for 30 days.

PUCT Opens New Rulemaking Project…

Opened on September 9, 2008 by Staff:
 
Docket 36131 – Rulemaking relating to disconnection of electric service and deferred payment plans.
 
I suspect this is will be to address the “extreme weather” issues in an attempt to avoid future emergency petitions.
